For anything not expressly governed by the following terms and conditions of sale, please refer to the provisions of law referred to in Legislative Decree 185/1999. The protection of confidentiality will be subject to the regulations of Legislative Decree 196/2003.
User account (e-shop).
When setting up a user account, you have to enter your email address and full name, and define your password for the account. The provision of data is voluntary, but necessary to set up an account. At the stage of setting up the account or when editing the user profile, you can enter additional data about yourself, that is billing address, shipping address, phone number, company data. The provision of such data is absolutely voluntary. You can have an account without entering any additional data. In this situation, when you place an order, you will have to enter additional data.
The data entered by you as part of the user account are processed only for the purpose of maintaining the account and enabling you to use the account. The provision of data in the user account is to facilitate for you placing orders in the shop by automatic completion of data in the order form.
Products, prices and characteristics.
Unless otherwise indicated, the prices of the Products published on the site always include VAT. Product prices may be updated over time, replacing previous prices. Images and features of the Products are indicative only and therefore not binding. The contents of the Products may differ from what is shown in the images.
Orders.
When placing the order (via website or over the phone), you have to enter data necessary for the execution of order, that is full name, billing address, phone number. You can also enter a different shipping address and company data. We process your data concerning payment and IP number. The provision of data is voluntary, but necessary to place an order.
By submitting an order, the customer accepts and undertakes, in the agreement with Pendragon Game Studio, to observe the provisions and these terms and conditions of sale. Therefore, the submission of the order confirmation implies the customer’s full knowledge and acceptance of these terms and conditions of sale.
The customer also declares that they are a consumer under Legislative Decree 185/1999, that they are of legal age and that they have provided correct and truthful data.
The customer agrees, once the purchase procedure is completed, to print and keep these conditions of sale.
All orders must be complete in all their required parts and once transmitted they will constitute a contractual proposal by the Customer, which will become binding once confirmed and accepted. Fulfillment of the order by Pendragon Game Studio therefore shall be equivalent to confirmation and acceptance of the order.
Orders not paid for by the Customer will be reversed and cancelled after 7 business days, nullifying any charge by Pendragon Game Studio srl.
Pendragon Game Studio will accept orders only for products that are available online, maintaining pre-orders and any reservations in case of temporarily out of stock products. Pendragon also agrees to promptly notify Customers of any out-of-stocks products. Incomplete orders will never be shipped without prior authorization from the Customer.
Shipping and Delivery
Pendragon Game Studio agrees to ship paid merchandise as quickly as possible. Indicatively, and not bindingly, Pendragon Game Studio will endeavor to process the order and deliver the ordered goods to the courier within 5 business days, from the date the payment was received. Delivery times will vary based on the municipality of delivery and the timing indicated by the courier.
It will be the responsibility of the Customer to verify upon receipt of the shipment that the package is intact, not damaged, wet or opened. If this is not the case, the Customer may refuse the delivery, but in the event that it is accepted, it will no longer be possible to object to the external characteristics of what has been delivered.
Methods of Payment
Payment of orders for purchasing products and any shipping costs must be made by the customer via one of the methods proposed by the site, that is, via PayPal / Credit Card and bank transfer.
In case of payment via Pay Pal by credit card, financial information will be forwarded via encrypted protocol to PayPal (www.paypal.com), without Pendragon Game Studio having access to such information.
In case of payment by bank transfer paid in advance, the Customer must make the payment to the bank routing numbers that will be communicated by the system during the acceptance of the order. Orders paid in advance by bank transfer will not be processed until payment is received on the indicated bank account and for the relevant amount. To speed up the processing of your order, we recommend that you send transfer receipts to the following mail address: info@pendragongamestudio.com.
Right of withdrawal and returns
According to Article 5 of Legislative Decree 185/1999, the customer has the right to withdraw from the purchase contract for any reason, without explanation and without penalty. To exercise this right, the customer must send Pendragon Game Studio notice of intention to proceed with the right of withdrawal within 14 working days from the date of receipt of the purchased product. Such notice must be sent by registered letter with return receipt to the following address: Pendragon Game Studio srl – Via Curtatone, 6 – 20122 Milan (ITALY). Following receipt of the notice of withdrawal, Pendragon will notify the customer of the instructions and procedures for returning the product or order on which the right of withdrawal has been expressed. Once the customer receives instructions by Pendragon Game Studio, the return of the product(s) must be made no later than 48 hours.
The right of withdrawal applies to the product purchased in its entirety. Therefore, the returned product must be intact and returned in its original packaging, complete in all its parts and with the protective cellophane.
In addition, the returned product must be returned free of any dents, scratches, cuts or other damage that would reduce its commercial value. By law, shipping costs are the responsibility of the customer, unless otherwise agreed upon.
The shipment of the returned product, until its delivery, is under the full responsibility of the customer. In case of damage to the product during transport, Pendragon Game Studio will notify the customer of the incident so that they can file a complaint against the courier in a timely manner.
Once it is ascertained that the conditions for a refund are met, Pendragon agrees to make the bank transfer related to the returned product or order within 10 business days since receipt of the return. It will be the responsibility of the customer to promptly provide the bank details (IBAN of the customer) on which to issue the relevant transfer.

Applicable Law
Without prejudice to the possible applicability of mandatory provisions of law placed for the protection of consumers (as defined pursuant to art. 1 letter B) of Legislative Decree 185/1999), any dispute will be under the exclusive jurisdiction of the Court of Milan.
This contract of sale between the customer and Pendragon Game Studio srl is concluded in Italy and governed by Italian law.
